Good Open Records Bill

Updated: Apr 25, 2020

HB 232 is a simple piece of legislation that would change the MAY to a SHALL when being awarded attorney fees and other costs related to Open Records Requests in which the requester had to take the government agency to court in order to procure those records. Citizens shouldn't be left holding the financial bag when the Government was required to turn over records and they did not comply. Government not paying these fees back to the requestor is a way of punishing them for exercising their statutory rights. In fact in some instances when a requestor wins an appeal to the Attorney General the state agency actually turns around and sues the requestor.

We encourage every one to call the Legislative Hotline at 502-564-8100 or 1-800-372-7181 and ask your Representative, All House Leadership, and Members of the House Judiciary to support HB 232.

This is a pretty simple bill, good bill that should be passed, and shouldn't take a lot of the legislature's time.
